The Owner-Operator Independent Drivers Association is showing its support for the Public Service Commission of West Virginia’s proposed amendments regarding third-party towing.
In initial comments filed on Tuesday, June 14, OOIDA thanked the commission for its efforts to protect motorists from excessive towing bills. In May, the West Virginia commission recommended a full refund of $185,894.91 for an inflated bill.
“We applaud the West Virginia Public Service Commission’s effort to amend its motor carrier rules governing third-party tows,” OOIDA wrote. “Based on our significant personal experience and the experience of our members, this is a necessary and worthwhile process to ensure that motorists are better protected from unscrupulous towing operators.”
The West Virginia commission’s proposed amendments include requiring the tow company to send a detailed copy of the invoice to the registered owner within 24 hours, allowing the owner of the vehicle to retrieve personal items at no additional cost, and establishing a process to resolve third-party tow complaints.
OOIDA showed support for all of the commission’s proposals, but the Association did offer some suggestions to the resolution process, which would hold the towing company more accountable when it fails to make a reimbursement for excessive charges within 20 days.
The commission also plans to review its maximum statewide wrecker rates through a general investigation.
“Not only are we involved with this process, we are also encouraged that they’re going to review the maximum statewide rates, including the individual tariffs,” said Mike Matousek, OOIDA director of state legislative affairs. “We’re looking forward to being a part of that process.”
